Last updated: May 2026. These terms govern the working relationship between you and Nina Mistry for any services booked through this website.
These terms and conditions apply to all clients who engage Nina Mistry ("Nina") for freelance services, including but not limited to launch management, funnel builds, email marketing, newsletter management, and technical marketing support.
Nina Mistry operates as a sole trader in the United Kingdom. By booking or engaging services, you confirm that you have read, understood and agreed to these terms.
The scope of work for each project is agreed between Nina and the client before work begins, either via a discovery call, written proposal, or service description on this website.
Nina reserves the right to decline any project at her discretion. Acceptance of a booking or deposit does not guarantee commencement of work if circumstances arise that make the project unsuitable.
Any changes to the agreed scope of work must be agreed in writing before additional work is undertaken. Out-of-scope requests may be subject to additional fees.
Fees are as stated on this website or in a written proposal. All prices are quoted in GBP and are exclusive of VAT (Nina is not currently VAT registered).
A non-refundable deposit of 50% is required before work begins. The remaining balance is due upon completion, before final files or login credentials are handed over.
Monthly services (such as newsletter management) are invoiced in advance at the start of each month. Payment is due within 7 days of invoice. Continued non-payment may result in services being paused.
Invoices not paid within 14 days of the due date may incur a late payment charge of 8% per annum above the Bank of England base rate, in line with the Late Payment of Commercial Debts (Interest) Act 1998.
The initial deposit is non-refundable. If a project is cancelled by the client after work has commenced, Nina reserves the right to charge for work completed to date at her standard hourly rate.
If Nina is unable to complete the project due to her own circumstances, any fees paid for work not yet completed will be refunded in full.
For monthly retainer services, either party may cancel with 30 days written notice. No refund is issued for work already delivered within the notice period.
To deliver work on time and to the agreed standard, Nina requires timely access to materials, platforms and feedback from the client. Delays caused by the client may affect delivery timelines and Nina cannot be held responsible for these.

On receipt of final payment, all deliverables created specifically for the client (copy, designs, email templates, build configurations) become the property of the client.
Nina retains the right to reference completed projects in her portfolio and case studies, unless the client requests otherwise in writing.
Any tools, templates, frameworks or processes developed by Nina that are reused across multiple clients remain Nina's intellectual property.
Nina treats all client information as confidential and will not share business details, strategies, or data with third parties without permission.
Clients agree to keep any proprietary processes, pricing or methods shared by Nina confidential and not to share them with third parties.
Nina will carry out all work with reasonable care and skill. However, Nina cannot guarantee specific outcomes such as revenue growth, list size, or conversion rates, as these depend on many factors outside her control.
Nina's liability to the client is limited to the total fees paid for the specific project or service in question. Nina is not liable for any indirect, consequential or incidental losses.
Nina is not responsible for issues caused by third-party platforms (email marketing tools, payment processors, website hosts, etc.) that are outside her control.
Nina may occasionally work with trusted associates to support project delivery. Any associate involved in your project will be bound by the same confidentiality obligations. Nina remains your primary point of contact and is responsible for the overall quality of work delivered.
These terms are governed by the laws of England and Wales. Any disputes arising from these terms or services provided will be subject to the exclusive jurisdiction of the courts of England and Wales.
These terms may be updated from time to time. The date at the top of this page reflects the most recent version. Continued engagement with Nina's services following any update constitutes acceptance of the revised terms.
